Giveaway. This giveaway ends on October 12, 2023 at 11:00 am PT (the “Giveaway”). This Giveaway is put on by HireVue, Inc. (“HireVue”). Subject to the Eligibility provisions below, an individual who (a) accurately completes all requested information on the provided entry form after (i) scheduling a time in advance to meet with HireVue at it’s HR Tech 2023 booth and completing the meeting, and/or (i) completion of a brief meeting or demonstration relating to HireVue’s solution at its HR Tech 2023 shall be an “Entrant.” Up to two entries may be available per person. For each entry, the entrant will receive a key which may open a vault at the HireVue’s HR Tech booth inorder to win the Prize.
Entry & Eligibility. Employees and members of their households, whether or not related, and immediate families (spouses, parents, siblings, children and each of their respective spouses) or individuals with Analyst/Media, Exhibitor/Sponsor, Student/Faculty, Expo Only Pass are not eligible, unless they are employees of HireVue customers. In the event of unforeseen circumstances beyond HireVue’s reasonable control, HireVue reserves the right to cancel, terminate, modify, or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
Winner. One giveaway winner (“Winner”) will be identified to receive the Prize. The Winner will be selected by (a) returning to HireVue’s HR Tech booth by October 12, 2023 at 4 pm PT (“Deadline”) and successfully opening the vault containing the Prize using the key(s) they were given as part of their entry. If no Winner is identified by the Deadline, a substitute Winner will be identified through a random drawing from among all eligible entrants. HireVue’s decisions with respect to the prospective Winner, these Official Rules, and all other matters pertaining to the Giveaway shall be final and binding. Prospective Giveaway Winner will be required to sign an affidavit of eligibility and release of liability and publicity (where permitted), and return same, properly executed, within five (5) days of issuance of prize notification. If HireVue is unable to contact the prospective Giveaway Winner, the prospective Giveaway Winner fails to complete and return all requested forms or to comply with any of the requirements, their prize will be forfeited and an alternate prospective Winner shall be selected. The odds of winning depend upon the number of eligible Entries received.
Prize. The Giveaway Winner will receive the following (the “Prize”): Four tickets to a Taylor Swift concert selected at HireVue’s sole discretion and a $2,000.00 AMEX gift card. Approximate Retail Value of the Prize: $5,500. Any difference between stated value and actual value will not be awarded. Prize is non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of Sponsor. The specifics of all aforementioned elements of the Prize in the Giveaway shall be solely determined by HireVue. In the event the Prize is not available for any reason, HireVue may replace the Prize with an equivalent to be determined at HireVue’s sole discretion. HireVue is not responsible for injury or damage to entrants, Winner or any other person related to or resulting from participating in this Giveaway or use of the Prize. Prizes are non-negotiable, non-transferable, and non-refundable. No cash alternative is available. All costs, taxes, fees, and expenses associated with any element of the Prize not specifically addressed above are the sole responsibility of the Winner. All federal, state and local taxes on the Prize are the Winner’s responsibility. The Winner will be issued a 1099 tax form for the actual value of the Prize.
Compliance with Corporate Policies. Entrant hereby represents and warrants their participation does not violate any policies, rules, or regulations of their employer, including their employer’s policy regarding the acceptance of gifts or their value, if applicable. Entrant shall be solely responsible for ensuring their participation in the Giveaway complies with their company’s gifting policies, and HireVue shall bear no responsibility for any disputes arising from such policies. HireVue reserves the right to disqualify any, violates any of HireVue’s rules or policies, or is found to be ineligible for the Giveaway. Entrant understands that non-compliance with these terms may result in their disqualification from the Giveaway and potential legal consequences.
Privacy Policy. By entering, you hereby agree to the collection and usage of your personal information in accordance with HireVue’s privacy policy, available at Hirevue.com/legal.
Publicity. Except where prohibited, participation in the Giveaway constitutes Entrant’s consent to use of their name, photograph, likeness, statements, biographical information, voice, information provided on entry form, and/or state of residence for advertising purposes in any and all media, now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission.
Indemnification and Limitation of Liability. By entering, Entrant agrees to release, discharge, indemnify and hold harmless HireVue, including its employees, directors, shareholders and affiliates, from and against all claims and damages or liability arising in connection with their participation in the Giveaway and/or Entrant’s receipt or use of any prize awarded in this Giveaway or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly from the Giveaway. Any and all warranties are disclaimed. ANY CLAIMS, DAMAGES, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS GIVEAWAY OR $100, WHICHEVER IS GREATER. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD-PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
Disputes and Governing Law. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of any entrant or the Giveaway Entities in connection with the Giveaway, shall be governed by and construed in accordance with the laws of Utah without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of Utah.
Severability. If any provision of these Official Rules shall be held invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law and the HireVue’s fundamental intentions hereunder, and the remaining provisions shall not be affected or impaired, provided, however, that in such cases the parties oblige themselves to use their best efforts to achieve the purpose of the invalid provision by a new legally valid stipulation.
